Terms of Service

The rules for using KarmaCart, written as plainly as we could. Each section starts with a short summary, but the full text is what counts.

1.Agreeing to these terms

In shortBy using KarmaCart you agree to these terms.

These Terms of Service ("Terms") are an agreement between you and Clear Tribe Solutions LLC ("KarmaCart," "we," "us"). They cover our website, browser extension, accounts and related services (together, the "Service").

If you use the Service on behalf of an organization, such as a charity, you agree to these Terms for that organization and confirm you are authorized to do so. If you do not agree, please do not use the Service.

2.Who can use KarmaCart

In shortYou need to be 18 or older and in the U.S.

You must be at least 18 years old, or the age of majority where you live, and a resident of the United States to create an account.

You are responsible for keeping your login secure and for activity on your account. Tell us right away at [support email] if you think someone has accessed your account without permission.

3.How KarmaCart works

In shortStores pay us a commission; we use it to fund donations and run the Service.

When you shop at a participating store through our links or extension, the store or its affiliate network may pay KarmaCart a commission. KarmaCart uses that commission to fund donations to the cause you choose and to operate the Service.

Commissions are paid to KarmaCart, not to you. You do not earn cash back, points or any other payment from KarmaCart.

4.Deals and savings

In shortDeals come from stores and can change or fail to apply.

Deals, coupon codes and discounts are offered by stores, not by KarmaCart. They may have exclusions, minimums or expiration dates, and stores can change or end them at any time.

We work to show accurate deals but cannot guarantee that a deal will apply to your order or that it is the lowest price available. Your purchase is between you and the store, and the store’s own terms, return and refund policies apply.

5.Donations

In shortClear Tribe Solutions LLC makes the donation. It is not tax-deductible for you.

Donations are made by Clear Tribe Solutions LLC to the eligible U.S. 501(c)(3) organization you select. Because Clear Tribe Solutions LLC is the donor, donations are not tax-deductible for you and you will not receive a tax receipt.

A donation is earned only after the store confirms your purchase and pays the commission. Purchases that are canceled, returned or not confirmed by the store do not generate a donation. Donations are typically paid to charities on a monthly schedule after they are confirmed.

If you change your cause, future donations go to your new cause. If your selected charity loses its 501(c)(3) status, cannot be paid or declines to receive funds, we will ask you to choose another cause, and may direct the donation to a similar eligible organization if you do not respond within [60] days.

Showing a charity in KarmaCart does not mean that charity endorses or is affiliated with KarmaCart, unless the charity has claimed its profile.

6.Charity partners

In shortCharities that claim a profile agree to a few extra terms.

Organizations that claim a profile must provide accurate information, including their legal name and EIN, and keep their payout details current. We may verify an organization’s status at any time.

Charity dashboards show aggregate totals. Charities do not receive the names or personal information of individual KarmaCart users unless a user chooses to share it.

We may remove a profile or withhold payouts if an organization is no longer eligible, provides false information or violates these Terms.

7.Acceptable use

In shortUse KarmaCart honestly.

You agree not to: place fraudulent orders or orders you intend to return in order to generate donations; use bots, scripts or other automated means to access the Service; interfere with or attempt to bypass store or affiliate tracking; copy, modify, reverse engineer or resell the Service or extension; or use the Service in a way that breaks any law or store policy.

We may reverse donations tied to activity that violates these Terms.

8.The browser extension

In shortWe give you a license to use the extension; you can uninstall it anytime.

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the KarmaCart extension for its intended purpose. The extension may update automatically.

The extension only runs on supported store websites. You can turn off deal pop-ups in your settings or uninstall the extension at any time. Our Privacy Policy explains what data the extension uses.

9.Our content and trademarks

In shortKarmaCart content belongs to us; store and charity marks belong to their owners.

The Service, including its design, text, illustrations, logos and software, is owned by KarmaCart or its licensors and protected by intellectual property laws.

Store and charity names and logos are trademarks of their owners. We use them only to identify those stores and charities, and their use does not imply sponsorship or endorsement. Chrome is a trademark of Google LLC.

10.Stores and other websites

In shortWe are not responsible for stores or other sites.

The Service links to websites and stores we do not control. We are not responsible for their products, content, prices, shipping, privacy practices or customer service.

11.Disclaimers

In shortThe Service is provided as is.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, KARMACART DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY DEAL OR DONATION WILL BE AVAILABLE.

12.Limitation of liability

In shortOur liability is limited.

TO THE FULLEST EXTENT ALLOWED BY LAW, KARMACART WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD 100).

13.Indemnification

In shortIf your misuse of KarmaCart leads to a claim against us, you cover it.

You agree to defend and indemnify KarmaCart and its officers, employees and agents from claims, losses and expenses arising from your misuse of the Service or violation of these Terms.

14.Disputes and governing law

In shortMost disputes go to individual arbitration.

These Terms are governed by the laws of the State of [State], without regard to conflict of law rules. Except for small claims court matters, you and KarmaCart agree to resolve disputes through binding individual arbitration administered by [arbitration provider], and waive the right to a jury trial or to participate in a class action.

You may opt out of arbitration by emailing hello@karmacart.app within 30 days of first accepting these Terms.

15.Changes and ending your account

In shortWe may update these terms; you can leave anytime.

We may update these Terms from time to time. If we make material changes, we will notify you by email or in the Service before they take effect. Continuing to use the Service after changes take effect means you accept them.

You can delete your account at any time in Settings. We may suspend or end your access if you violate these Terms. Donations already confirmed before your account ends will still be made.
